TERMS AND CONDITIONS
The services are operated by Best Present Limited. We are registered in England and Wales under company number 09791912 with our registered office address at 47 Dagmar Avenue HA9 8DQ.
1.1 These Terms and Conditions shall apply to all contracts for the supply of Goods and Services by Best Present Limited to the Customer and shall prevail over any other documentation or communication from the Customer.
1.2 Any contract between us, whether for use of the site or in relation to the purchase of products through the site will be governed by the laws of England and Wales and both parties, (you and BestPresent Limited).
1.3. Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by Best Present Limited.
1.4 Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which Best Present Limited may be entitled in relation to the Goods and Services, by virtue of any statute, law or regulation.
1.5 Nothing in these Terms and Conditions shall affect the Customer’s statutory rights as a Consumer.

2.2 If you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party. We have the right to disable any user identification code or password at any time, if in our opinion you have failed to comply with any of the previous of these Customer Terms. Also, it is your responsibility to ensure that all information (including your name and address) you upload to the Site is correct and accurate. Ensure that you check all information before making a purchase.
2.3 Best Present has taken every care in the preparation of the content of this website, however we will not be liable if for any reason any of the services are unavailable at any time or for any period. We cannot guarantee uninterrupted and totally reliable access to this website and so, therefore, cannot guarantee that the information will always be completely up to date and free of mistakes.
Best Present shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this web site and will accept no liability for any loss or damage arising as a result of problems with access.
2.4 Certain (hypertext) links in this site may lead to other web sites which are not under the control of Best Present Limited. When you activate any of the links you will leave the web site and Best Present Limited has no control over and will accept no responsibility or liability for the material on any web site which is not under the control of Best Present Limited;
3 THE ORDER
3.1 Once an order has been placed we will confirm that your order has been received by sending an e-mail to the e-mail address you provide in your registration form. In the event of there being any discrepancy in price or should any product be no longer available we will contact you to explain the position and to ask for your agreement.
3.2 The quantity, quality and description of the goods will be those set out in your order (if accepted by us as we reserve the right to reject any order). Orders are accepted if the goods are available, the order reflects current pricing, you are based in the Delivery Area and your Payment Card is authorised for the transaction. You or we are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the Goods appearing on our website.
3.3 You shall be responsible for ensuring the accuracy of the terms of any Order submitted by you, and for giving us any necessary information relating to the goods within a sufficient time.
4 PRICE AND PAYMENT
4.1 The price of the goods shall be the price set out on the relevant page of this site. If the price of the goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e-mail or in writing that the new price is acceptable. If it is not acceptable then you will have the option of cancelling the order.
4.2. The price of goods does not include insured postage and packaging. There will be an additional charge made relative to the size and amount of goods insured for postage and packaging. This charge will be clearly shown on the final price and order form.
4.3 No additional discounts may be used gainst Sale items.
4.4 When submitting the order you will have to confirm that the information contained within the order is true and accurate and authorize us to deducts from the Payment Card account the payment
4.5 If it is not possible to obtain full payment for the goods from your account we reserve the right to cancel the order. All credit and charge card holders are subject to validation checks and authorization by the card issuer. Normally, we will debit your card just prior to dispatch of your order, except in the case of any personalized items, where payment has to be taken at the time of ordering.
4.6 Where Goods are returned by you in accordance with your rights under the provisions of Clause 9, we shall credit the Payment Card with the appropriate amount.
5.1 Delivery of the Goods shall be made by us or our courier to the address specified in the Order Form.
5.2 The date of delivery specified by us is an estimate only. We will do all that we reasonably can to meet the date given for delivery. If we are unable to make the delivery date for reasons beyond our control we will contact you.
5.3 All risk in the Goods shall pass to the Customer when they are in the physical possession of the Customer. As soon as we have delivered the goods or services, you will be responsible for them. If you delay a delivery our responsibility for everything, other than damage, will end on the date we agree the delivery date.
5.4 In the event that goods are returned to us as a result of incorrect address or shiping details provided by you we will apply to you a handling fee of £5.
5.5 Goods supplied to you are not for resale.
6.1 Subject to the provisions of clause 9 the property of goods shall not pass to you until we haven’t received the payment in full for the Goods.
7 CUSTOMER’S OBLIGATIONS
To enable Best Present to perform its obligations you shall:
- co-operate with Best Present;
- provide us with any information reasonably required;
- obtain all necessary permissions, licenses and consents which may be required before the commencement of the services, the cost of which shall be the sole responsibility of the Customer; and
- comply with such other requirements as may be set out in the contract or otherwise agreed between the parties.
8 SUPPLIER’S OBLIGATIONS
8.1 Best Present warrants that the Goods will at the time of delivery correspond to the description given by you.
8.2 Best Present will make sure to perform the Services with reasonable skill and care and to a reasonable standard in accordance with recognised standards and codes of practice.
8.3 Best Present accepts all responsibility for the condition of tools and equipment used in the performance of the Services and shall ensure that any materials supplied shall be free of defects.
9 CANCELLATIONS AND REFUNDS
9.1 Where the Goods are faulty or do not comply with any of the contract, you must notify us immediately on the day of delivery for an advice and if it is the case you will be entitled of replacement Goods or a full refund. Any claim by you based on any defect in the quality of the goods must be notified to the company in writing by email in 48 hours after the delivery.
9.2 Goods must be returned complete, unused and in their original as new condition, in 14 days, with all accessories and instructions and also in its original packing. We will ask the reason for your return in order to value your feedback .
9.3 You shall bear the cost of returning the Goods. You should use a tracked, insured service, as you are responsible for the Goods until they are received by us. We will advise you how to return the goods to us.
9.4 Best Present will make the reimbursement no later than 14 days after we received from you the goods supplied. Note that it may take up to 14 days for your bank to credit your account. We will use the same means of payments as you used for the initial transaction, unless you have expressly agreed otherwise.
9.5 You won’t be able to cancel this contract in case of :
- Personalised goods or goods made to order;
- Newspapers, personalized books.
11 FORCE MAJEURE
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
